Welcome to RAYCOZ!

These Terms of Service (“Terms”) govern your use of our games, mobile applications, websites, and related services (collectively, the “Service”) provided by RAYCOZ ( “we,” “us,” or “our”). By using the Service, you agree to these Terms and our Privacy Policy, which is incorporated by reference.

Quick Summary (non-binding):

  • You must be 13 or older to use the Service (with parental consent if under 18).
  • You’re granted a limited license to use the Service for personal, non-commercial enjoyment.
  • Purchases of virtual items are generally non-refunded unless required by law.
  • We may update these Terms, and continued use means you accept changes.

1. Using the Service

1.1. Agreement to Terms

By installing, accessing, or using the Service (e.g., browsing our website, downloading our app, or playing our games), you agree to these Terms and our Privacy Policy. If you don’t agree, please do not use the Service. Use of the Service is not permitted where prohibited by law.

1.2. Eligibility

  • Age: You must be at least 13 years old to use the Service. If you’re 13–17, your parent or legal guardian must review and agree to these Terms. We may require age verification or parental consent to comply with laws like the U.S. Children’s Online Privacy Protection Act (COPPA).
  • Social Media Accounts: If you access the Service through a social media platform (e.g., Google, Apple, or Facebook), you must also comply with that platform’s terms of service.
  • Account Registration: You may need to create an account (“Account”) to use certain features. You must provide accurate information and not create an Account for anyone else without their permission.

1.3. Changes to Terms

We may update these Terms, our Privacy Policy, or other policies at any time by posting the changes on the Service (e.g., at Terms of Use). We’ll notify you of significant changes via email or in-app messages where feasible. By continuing to use the Service after changes are posted, you accept the updated Terms. If you don’t agree, you must stop using the Service.


2. License to Use the Service

2.1. Limited License

Subject to these Terms, we grant you a non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for personal, non-commercial entertainment purposes (e.g., playing games or interacting with features). This license does not permit other uses, such as selling access or using the Service for advertising.

2.2. Account Rules

  • One Account per User: You may only have one Account per game per supported device.
  • Login Security: You’re responsible for keeping your Account login information (e.g., password) confidential. Don’t share your Account with others or let anyone else use it. Notify us immediately at support@raycoz.com if you suspect unauthorized access.
  • Your Responsibility: You’re responsible for all activity on your Account, including purchases, whether authorized by you or not.
  • Username Rights: We may remove or reclaim usernames that violate these Terms or third-party rights (e.g., trademark infringement).

2.3. Restrictions

You agree not to:

  • Use the Service if you’re under 13 or have been banned by us.
  • Create an Account with false information or on behalf of someone else.
  • Sell, rent, or give away your Account or access to the Service.
  • Use cheats, bots, hacks, or unauthorized software to modify the Service or gain an unfair advantage.
  • Disrupt the Service or other users’ experiences (e.g., through win trading, exploiting bugs, or overloading servers).
  • Post or share content that’s abusive, threatening, obscene, defamatory, or otherwise harmful.
  • Attempt to access unauthorized parts of the Service, such as other users’ Accounts or our servers.
  • Reverse engineer or modify the Service without our written permission.
  • Collect or share others’ personal information without consent.
  • Use the Service for commercial purposes, like advertising, unless expressly allowed (e.g., authorized streaming).

Violating these restrictions may result in Account suspension or termination (see Section 2.4).

2.4. Suspension and Termination

  • By RAYCOZ: We may limit, suspend, or terminate your Account or access to the Service if we believe you’ve violated these Terms or engaged in illegal or improper use, with or without notice. This may result in loss of your username, virtual items, or other benefits, and we’re not required to compensate you unless mandated by law.
  • Appeals: If your Account is suspended or terminated, you may request a review within 30 days by contacting support@raycoz.com. We’ll respond within a reasonable time.
  • Inactivity: We may terminate Accounts inactive for 180 days. We’ll attempt to notify you via email beforehand.
  • By You: You may terminate your Account at any time by following instructions at support@raycoz.com.
  • Service Discontinuation: We may discontinue the Service or parts of it (e.g., a specific game) at any time. If we do, we’ll provide at least 30 days’ notice where feasible and aren’t obligated to refund unused virtual items unless required by law.

3. Ownership

3.1. Service and Content

We (or our licensors) own all rights, title, and interest in the Service, including games, code, artwork, music, characters, and other content. All intellectual property rights are reserved.

3.2. Accounts

You don’t own your Account; it’s a limited license to access the Service. All rights to Accounts belong to us.

3.3. Virtual Items

Virtual currency, in-game items, or other digital goods (“Virtual Items”) are licensed to you for use in the Service. You don’t own Virtual Items, whether earned or purchased, and they have no real-world value outside the Service.


4. User Content

4.1. What is User Content?

“User Content” includes anything you or other users upload, post, or share through the Service, like chat messages, profile images, or forum posts.

4.2. Your Responsibilities

By sharing User Content, you confirm that it:

  • Is accurate and not misleading.
  • Doesn’t violate laws, contracts, or third-party rights (e.g., copyrights or privacy).
  • Is free of viruses or harmful code.
  • Complies with our content guidelines (e.g., no abusive or offensive material).

You’re solely responsible for your User Content. Don’t share personal information that could compromise your privacy or security.

4.3. Our License to Use Your Content

You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, display, and distribute your User Content solely to operate, provide, and promote the Service (e.g., showing your chat messages in-game or featuring your fan art in marketing with your permission). This license ends when you delete your User Content or terminate your Account, except for content already shared publicly or with others.

4.4. Content Moderation

We don’t pre-screen all User Content but may review, edit, or remove it at our discretion if it violates these Terms or is reported as inappropriate. You can report problematic content at support@raycoz.com. We’re not responsible for User Content or your interactions with it, and you use the Service at your own risk.

4.5. Public Sharing

Forums, chats, or blogs are public spaces. Don’t post ideas or information you want to keep private, as others may use them without our control. We’re not obligated to compensate you for ideas you share.


5. Purchases and Payments

5.1. Virtual Items and Merchandise

You may purchase a limited, non-transferable, revocable license to use Virtual Items (e.g., virtual currency or in-game items) or other goods/services (“Merchandise”) through the Service. Purchases must be made via us or our authorized partners, not third parties.

5.2. Payment Terms

  • You agree to pay all fees and taxes for purchases made through your Account.
  • Prices may vary by region and include applicable taxes, as shown at checkout.
  • We may adjust pricing at any time, but this won’t affect prior purchases.

5.3. Refund Policy

Purchases are generally final and non-refunded, except where required by law (e.g., EU’s 14-day withdrawal right for digital goods). If you believe you’re eligible for a refund (e.g., due to unauthorized purchases or technical issues), contact support@raycoz.com within 14 days of purchase. We’ll review requests in line with our policies and legal obligations.

5.4. Unauthorized Purchases

If a minor makes unauthorized purchases, parents or guardians may request a review at support@raycoz.com. We encourage using parental controls to prevent such issues.

5.5. Virtual Item Management

We may modify, regulate, or remove Virtual Items at any time. If we discontinue a game, we’ll provide at least 30 days’ notice where possible and may offer limited alternatives (e.g., transferring items to another game), but we’re not obligated to compensate you unless required by law.


6. Updates to the Service

The Service evolves over time. We may release updates to games or features, which you must accept to continue using the Service. Updates may occur automatically, and you may need to update third-party software (e.g., your device’s operating system) to maintain compatibility. For significant changes that reduce functionality, we’ll aim to notify you in advance via email or in-app messages.


7. Disclaimer of Warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied (e.g., warranties of merchantability, fitness for a particular purpose, or non-infringement). We don’t guarantee:

  • The Service will be uninterrupted, error-free, or available at all times.
  • Defects will be corrected.
  • The Service is free of viruses or harmful components.

Some jurisdictions don’t allow certain warranty exclusions, so your statutory consumer rights remain unaffected.


8. Limitation of Liability

To the maximum extent permitted by law:

  • We’re not liable for indirect, incidental, consequential, or punitive damages (e.g., lost profits, data, or business interruption) arising from these Terms or the Service, even if we’re aware of the possibility.
  • Our total liability to you is limited to the amount you paid us in the six months before your claim. If you haven’t paid anything, your sole remedy is to stop using the Service and cancel your Account.

This doesn’t limit liability for gross negligence, willful misconduct, or other cases where exclusions aren’t allowed (e.g., personal injury or fraud). Your statutory rights as a consumer are preserved.


9. Indemnification

You agree to indemnify and hold us (and our officers, directors, agents, and affiliates) harmless from third-party claims, damages, or losses (including reasonable attorneys’ fees) arising from your intentional or negligent misuse of the Service or breach of these Terms. This doesn’t apply if the issue isn’t your fault.


10. Dispute Resolution

10.1. Informal Resolution

If you have a concern, please contact us first at support@raycoz.com. We’ll aim to resolve it within 30 days.

10.2. Governing Law and Jurisdiction

These Terms are governed by Hong Kong law, without regard to conflict of law principles. Any disputes must be resolved exclusively in Hong Kong courts, except where local law requires otherwise (e.g., consumer claims in your home jurisdiction). You agree to submit to the jurisdiction of Hong Kong courts for non-consumer disputes.

10.3. Arbitration Option

For a faster, cheaper alternative, you may request arbitration through a mutually agreed provider. Arbitration is optional and doesn’t waive your right to pursue claims in court where required by law.


11. Severability

If any part of these Terms or our Privacy Policy is found illegal or unenforceable by a court, that part will be ineffective only in that jurisdiction, and the remaining Terms will remain in effect.


12. General Provisions

12.1. Assignment

We may assign these Terms or our Privacy Policy to another entity (e.g., during a merger) with or without your consent, but we’ll notify you of significant changes. You may not assign your rights or obligations without our written permission.

12.2. Supplemental Policies

We may publish additional policies for specific features (e.g., forums or contests). Your use of those features is subject to those policies and these Terms.

12.3. Entire Agreement

These Terms, our Privacy Policy, and any incorporated documents form the complete agreement between you and us about the Service, replacing any prior agreements.

12.4. No Waiver

If we don’t enforce a provision, it doesn’t mean we waive our right to do so later. Any waiver must be in writing and signed by us.

12.5. Notices

We may notify you via postings on raycoz.com, email, or in-app messages. You must send notices to us via email at support@raycoz.com or by mail to: Yun Kai Building, 466 Nathan Rd, Yau Ma Tei, Kowloon, Hong Kong. Notices not sent this way have no legal effect.

12.6. Equitable Remedies

You agree that a breach of these Terms could cause us irreparable harm, entitling us to seek injunctive relief without posting a bond. You waive your right to seek injunctions to stop the Service’s operation and limit claims to monetary damages (subject to Section 8).

12.7. Force Majeure

We’re not liable for delays or failures due to causes beyond our reasonable control, like natural disasters, war, cyberattacks, or labor disputes.
